StanceBeam Privacy Policy

The website located at www.stancebeam.com and the StanceBeam mobile application (together referred to as the "Platform") is owned and operated by Quick Logi Technologies India Private Limited ("QLT"), a company incorporated under the Companies Act, 2013, and having its registered office at D-2 West, Trinity Acres, Sarjapur Road, Bangalore, Karnataka - 560035. Through the Platform, QLT seeks to offer for sale the 'StanceBeam Striker' motion-intelligent, plug and play sensor device and offer personalized and real-time performance analysis ("Services") to Users of QLT ("Users").

The terms 'QLT' or 'us' or 'we' refer to the owners of the Platform. The terms 'you' or 'user', and all its grammatical variations, refer to the user or viewer of the Platform.

This Privacy Policy ("Policy") reflects QLT's commitment towards protecting the privacy and personal information provided by users of the Platform and sets out the nature and type of information QLT collects from users for the purpose of the Services, the usage and disclosure of such information, and the safety and security measures adopted by QLT to safeguard such information.

Please note that this Policy is only applicable to the users of the Platform and the information and data gathered on or through the Platform and not to any other information or Platform. You are hereby advised to read this Policy carefully and fully understand the nature and purpose of gathering and/or collecting sensitive, personal and other information and the usage, disclosure and sharing of such information. By requesting and consenting to the Services, you hereby also consent to QLT sharing information with third party service providers engaged by QLT for the purpose of the Services and to the transfer and/or storage of user information and data across borders.

Terms not defined herein will have the meaning ascribed to them in QLT's Terms of Use for the Platform, as available at https://www.stancebeam.com/term-of-use.

1. Purpose and Usage

This Policy explains:

-- the information we may collect about you online and/or through the Platform;

-- the use and role of cookies and similar technologies on our Platform;

-- how we will protect and use information we collect about and from you;

-- the circumstances in which we might disclose your details to anyone else;

-- when we may use your details to contact you; and

-- how you can be sure the information we hold about you is accurate and current.

2. Information Gathered

In general, you can visit our Platform without revealing your identity or any personal information about yourself. However, you may not be able to access significant portions and sections of the Platform or use the Services unless you register and sign up for the Services or reveal your identity and/or other information about you.

Information that we collect from you at registration or at any other time will vary depending upon the activity you seek to engage in, and in this respect, if you choose to sign up for our Services as an interested viewer, we shall, at the first instance collect a username, password and email address from you. Further, if you are registered on the Platform as a User and wish to avail the Services, as part of your profile on the Platform, you may be required to provide, inter alia, the following information:

• Date of Birth

• Gender

• Current Location

• Batting Style (Right/Left Hand)

• Grip Style (High/Medium/Low)

• Height

• Weight

• Profile Picture

In addition, we may collect demographic information such as information about your mobile device, computer, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, and other data that you may provide in surveys or while completing your account profiles. We may combine demographic information with Personal Information to tailor our offerings or web pages to your preferences or interests.

3. Personal Information

Personal Information means any information that may be used to identify you and that is not otherwise publicly available, including, but not limited to, your first and last name, age, place of residence and an email address, phone number or other contact information, photograph, as well as any information related to your profession, company, academy or organization.

We may collect Personal Information from you when you register and create a profile on the Platform to avail the Services, or otherwise voluntarily provide such information. Further, in the case of Users registering for the Services, we may use such Personal Information in order to verify your credentials, for the purpose of permitting continued access to our Services or otherwise to contact you in the course of rendering the Services.

We may use Personal Information and other information received and collected from you to provide the Services you have requested, to enable you to access and update your profile on the Platform, or any part thereof, and to contact you upon your request and when otherwise necessary. We may also use Personal Information for auditing, research and analysis, and to operate and improve our Services. In certain circumstances, we may share aggregated non-personal information with third parties. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Policy and any other appropriate confidentiality and security measures. We may also share such information with third parties in limited circumstances, including when complying with legal process, preventing fraud or imminent harm, and ensuring the security of our network and services.

4. Disclosure/Sharing

QLT may also share information as provided by you and data concerning usage of the Platform with third party service providers engaged by QLT, for the purpose of data analytics or other similar purposes, for the purpose of storage, improving the Services and helping QLT serve you better.

By using the Platform, you hereby expressly agree and grant consent to the collection, use and storage of this Personal Information by QLT. QLT reserves the right to share, disclose and transfer Personal Information collected hereunder with its own affiliates. In the event QLT sells or transfers all or a portion of its business assets, consumer information may be one of the business assets that are shared, disclosed or transferred as part of the transaction. You hereby expressly grant consent and permission to QLT for disclosure and transfer of information to such third parties. Further, QLT reserves the right to disclose Personal Information as obligated by law, in response to duly authorized legal process, governmental requests and as necessary to protect the rights and interests of QLT.

Where we propose to use your Personal Information for any other uses we will ensure that we notify you first. You will also be given the opportunity to withhold or withdraw your consent for your use other than as listed above.

5. Sensitive Personal Information

Sensitive Personal Information ("SPI") means such personal information which consists of information relating to your password; physical, physiological and mental health condition; medical records and history; biometric information, sexual orientation and financial information (such as bank account details or credit card numbers).

Except for your account password and any SPI that you choose to provide as part of your profile, QLT does not collect any SPI in the course of providing the Services. Any SPI collected by QLT shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or the Terms of Use or as provided in a separate written agreement between QLT and you or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to you on the Platform.

However, you acknowledge that in the course of providing the Services, QLT may receive SPI, either when you voluntarily choose to update your profile with information related to your identity, physical and physiological condition, or from such content posted by you on the Platform, and you hereby consent and agree to allow QLT to store and display the SPI collected in this manner on the Platform and disclose it in accordance with the terms of this Policy.

It is clarified that with respect to any SPI that you may share with QLT, you have the sole right to determine whether you want to share such information with QLT, and that you can continue to avail of the Services without the sharing of any SPI. Further, with respect to any SPI that you may share in the course of updating your profile, you have the right to determine the levels of access to such information, by adjusting the privacy settings of your account with the Platform.

6. Cookies and Other Tracking Technologies

Some of our web pages may also utilize "cookies" and other tracking technologies or tools. A "cookie" is a small text file that may be used, for example, to collect information about your activity on our Platform. Some cookies and other technologies may serve to recall Personal Information previously indicated by you. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you may need to re-enter your Personal Information to gain access to certain parts of our Platform.

Tracking technologies may automatically record information such as Internet domain and host names; other information about your geographic location; IP addresses; browser software and operating system types; CPU/mobile type; your manner of connecting to the Internet (e.g., connection speed through narrow-band or broadband access); click paths; and dates and times that our Platform is accessed. Such information does not identify the User personally.

Our use of cookies and other tracking technologies allows us to improve our Platform and consequently your experience using the Platform and the Services. We may also analyze information that does not include Personal Information for trends and statistics.

7. Confidentiality and Security

We will keep confidential and protect your SPI and Personal Information except where disclosure is required or permitted by law or in instances where use and disclosure thereof is permitted under this Policy.

We follow generally accepted industry standards to protect the SPI and Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. All information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password protected and is strictly limited. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your Personal Information and SPI, we cannot guarantee its absolute security.

QLT also believes that the internet is an ever-evolving medium. We may periodically review from time to time and change our privacy policy to incorporate such future changes as may be considered appropriate, without any notice to you. Our use of any information we gather will always be consistent with the policy under which the information was collected, regardless of what the new policy may be. Any changes to our Policy will be posted on this page, so you are always aware of what information we collect, how we use it, how we store it and under what circumstances we disclose it.

We limit access to SPI and Personal Information to employees who we believe reasonably need to come into contact with that information to provide Services to you or in order to do their jobs.

Third parties provide certain services available on our Platform and on our behalf. We may provide information, including Personal Information, to third-party service providers to help us deliver our products, information, and services efficiently and effectively. Service providers are also an important means by which we maintain our Platform and mailing lists. We will take reasonable steps to ensure that these third-party service providers are obligated to protect Personal Information on our behalf through confidentiality agreements and otherwise. We do not intend to transfer SPI and Personal Information without your consent to third parties who are not bound to act on our behalf unless such transfer is legally required. Similarly, it is against our policy to sell SPI and Personal Information collected online without consent.

If you choose to provide us with your SPI and Personal Information, we may transfer that SPI and Personal Information from your country or jurisdiction to other countries or jurisdictions around the world. Your SPI and Personal Information may be collected and stored on servers located in the territory of Australia, New Zealand, United Kingdom, India and such other countries as we may disclose from time to time.

8. Third Party Platforms

If you click on a link to a third-party site or otherwise leave the Platform, you will go to a platform that is outside the purview of our control. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. The use of Personal Information by such platforms shall be governed by the privacy policies provided therein. Therefore, if you visit a third-party platform that is linked to our Platform, you should consult that platform's privacy policy before providing any Personal Information.

9. Advertising

When QLT presents information to its online advertisers -- to help them understand our audience and confirm the value of advertising on the Platform -- it is usually in the form of aggregated statistics on traffic to various pages within our Platform. When you register on the Platform, we contact you from time to time about updating your content to provide features which we believe may benefit you.

10. Conditions of Use

QLT DOES NOT WARRANT THAT THIS PLATFORM, IT'S SERVERS, OR EMAIL SENT BY US OR ON OUR BEHALF ARE VIRUS FREE. QLT WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS PLATFORM, INCLUDING, BUT NOT LIMITED TO COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL AND CONSEQUENTIAL DAMAGES, LOSS OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

11. Contacting You

We may contact you using the Personal Information you have given us:

-- in relation to the functioning of any service you have signed up for in order to ensure that we can deliver the Services to you;

-- where you have opted to receive further correspondence;

-- to invite you to participate in surveys, opinion polls, etc., about our services or otherwise (participation is always voluntary); and

-- to provide you information about our new products and services, where you have specifically agreed to receive this.

12. Change of Control

In the event QLT sells or transfers all or a portion of its business assets, consumer information may be one of the business assets that are shared, disclosed or transferred as part of the transaction. You hereby expressly grant consent and permission to QLT for disclosure and transfer of information to such third parties.

13. Accuracy

To the extent that you do provide us with Personal Information and SPI, we wish to maintain accurate and current SPI and Personal Information. Where we collect SPI and Personal Information from you on our Platform, should you need to update or correct that SPI and Personal Information, please contact us and we will make reasonable efforts to incorporate the changes in your SPI and Personal Information that we hold as soon as practicable. You can obtain the information we currently hold on you by emailing QLT at contact@stancebeam.com from the email address provided to QLT at the time of registration on the Platform. We will use our best efforts to send you the information within 14 days of receipt of your email.

14. Termination of User Account

In the event that you choose to terminate and delete your user account with QLT, or if your account has been terminated for any other reason, such as a violation of the Terms of Use, your Personal Information may be retained and may continue to be used until: (i) the relevant purposes for the use of your information described in this Privacy Policy are no longer applicable; and (ii) we are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain your Personal Information and the retention of your Personal Information is not required for the establishment, exercise or defense of any legal claim.

15. Consent and Amendments

By using this Platform, you consent to the terms of this Policy and to our use and management of Personal Information and SPI for the purposes and in the manner herein provided. Should this Policy change, we intend to take every reasonable step to ensure that these changes are brought to your attention by posting all changes prominently on our Platform for a reasonable period of time. Your visit and any dispute over privacy are subject to this Policy.

16. Applicable Law

This Policy and information contained herein, shall be governed by the laws of the Republic of India and the courts of Bengaluru, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.
